Prominent Criminal Defense Attorney Had Obstruction of Justice and Evidence Tampering Charges Dismissed
A prominent criminal defense attorney was accused of obstructing justice and tampering with evidence during the defense of a high profile aggravated murder prosecution. A special prosecutor was selected to investigate and prosecute the case by the sitting elected county prosecutor.
Marein and Bradley tested the special prosecutor’s authority to use the grand jury to charge as outside of the special prosecutor’s powers. A motion to dismiss filed by Marein and Bradley was opposed by the special prosecutor, but granted by the trial court. The special prosecutor appealed the dismissal to the Ohio Court of Appeals. The Ohio Court of Appeals agreed with the dismissal. No further prosecution was attempted by the state.
Cleveland Fire Department EMT Found Not Guilty of Sexually Assaulting a Child
Twenty-year veteran Cleveland Fire Department EMT was accused of digitally penetrating a seven-year-old female child that his wife was babysitting. The client was exposed to a mandatory penitentiary sentence and the end of his career if convicted.

East Palestine Police Lieutenant Found Not Guilty of Sexual Assault
Lieutenant of East Palestine Police Department was accused of sexual assault of his 12-year-old granddaughter. Accusation was made during summer vacation when the child was staying with her grandparents. Lieutenant was looking at mandatory penitentiary sentence and the end of his career if convicted.
Marein and Bradley investigated the child’s background, home environment and school records and learned that the child had numerous unresolved emotional issues. After a week-long jury trial in Columbiana County, Ohio, the jury returned verdicts of NOT GUILTY to all charges.
Cleveland Man Found Not Guilty of Rape
Local construction worker was accused of raping his five-year-old son by inserting his penis in the child’s rectum. Medical slides of the child’s rectum showed serious injury. Allegations of sexual assault were filed during a bitter child custody case. Client was facing mandatory life imprisonment.
Marein and Bradley employed the services of a board certified pediatric-gastroenterologist, as well as a private investigator to secure sensitive medical records. At a hotly contested jury trial, Marein and Bradley proved that the child suffered from a chronic condition of severe constipation since birth which explained the extensive injury to the child’s rectum. The mother of the child, who testified for the prosecution, was exposed as manipulating the allegation and involving the criminal justice system to achieve her quest for custody. The client was found NOT GUILTY of all charges by the jury after a two-week trial.
Woman Found Not Guilty of Felony Assault on a Peace Officer and is Awarded a Substantial Cash Settlement
Client, a 30-year-old Jamaican woman, returned home from late shift (1:00 a.m.) from downtown hotel and called police to report that her driveway was blocked by a vehicle. Unbeknownst to her, police within five minutes of the call, were detaining a male and female directly outside of her home regarding an unrelated matter. Client witnessed the officers getting very physical with the couple and attempted to intervene to clarify that her call regarding her driveway did not require such a response. While attempting to explain her position, client was brutally beaten (broken jaw), thrown to the ground and arrested. She was later charged with obstruction of justice and felony assault on a peace officer.
Marein and Bradley rejected offers to release the officers of civil liability in exchange for a dismissal of charges and tried the case to a jury for one week. At the end of the case, client was found NOT GUILTY of all charges. Marein and Bradley filed a civil rights action in federal court resulting in a substantial cash settlement.
Cleveland Man Found Not Guilty of First Degree Felonious Assault
Twenty-year-old African-American male shot by Cleveland police office after being questioned while sitting in his car regarding an incident for which he had no involvement, knowledge or participation. The officer claimed the client drove his vehicle towards an officer who was standing outside the car on the driver’s side between the front of the vehicle and the driver’s side window. The officer, claiming self-defense, shot the client in his back and then caused the client to be charged with first degree felonious assault on a police officer.
Marein and Bradley caused a model of the exact vehicle door panel to be used at trial to re-create the incident. This re-creation established the impossibility of the officer’s claims resulting in a jury verdict of NOT GUILTY.
Marein and Bradley later filed a civil rights action in federal court resulting in a substantial cash settlement.
